MICHIGAN CHAMBER OF COMMERCE: New Data Security Mandates Passes Legislature

Michigan Chamber of Commerce issued the following announcement on Dec. 18.

As discussed in previous Advocacy News editions in the past, the Michigan Chamber has worked on legislation imposing new data security mandates on businesses for several years.

As Originally introduced, the regulatory mandates contained in the bill would have been costly and practically impossible to comply with, setting businesses up for failure. The Michigan Chamber worked diligently with the bill sponsor and other interest groups on compromise legislation that increases consumer protections while ensuring Michigan businesses could comply with the new mandates. HB 4187 (Farrington) broadly requires a business to do the following when they become aware that certain data within their possession is compromised:

· Protect sensitive personal identifying information.

· Investigate actual and potential breaches of security.

· Provide notice to persons in the event of a breach of security resulting in unauthorized acquisition of sensitive personal identifying information.

The Governor is expected to sign the legislation which, at the Michigan Chamber’s request, will not go into effect until January 20, 2022.
